Welcome to Aporiya, an England-based marketplace for pre-loved luxury fashion items. By submitting items for sale through www.aporiya.com, you accept the following Terms and Conditions. Please read them carefully as they constitute a legally binding agreement between you and Aporiya.
1. Introduction
Aporiya provides a platform for the sale of authenticated pre-loved luxury fashion items. By submitting an item for sale, you agree to comply with these Terms and Conditions, as well as Aporiya's guidelines for authenticity and condition of goods.
2. Seller Eligibility
• You must be 18 years or older to sell through Aporiya.
• You confirm you are the lawful owner of any items submitted and have the right to sell them.
• You confirm that all items submitted are authentic and described accurately in their condition and origin.
3. Seller Application Process
• Sellers must submit a Seller Form along with clear, high-resolution images of the items.
• Aporiya will review the submission and decide whether to accept the item based on internal guidelines. Sellers will receive all communication and status updates directly via email.
4. Item Acceptance & Authenticity
• Strict Authenticity Guarantee: Sellers must guarantee that all items listed are 100% authentic. Aporiya reserves the right to refuse any items if their authenticity is questioned.
• Aporiya performs an authentication process on every item before listing it. If an item is found to be inauthentic or counterfeit, Aporiya may ban the seller from future sales and may charge a fee for authentication and handling of the counterfeit item.
• Sellers are responsible for ensuring that any claims of authenticity are verifiable.
5. Ownership and Risk of Loss
• Ownership Retained: When you consign an item with Aporiya, you retain full legal ownership of the item until it is sold to a buyer. Aporiya does not acquire any ownership or title to your item, even after it has been delivered to us.
• Risk of Loss Before Delivery: For items valued below £500, you are responsible for any risk of loss or damage during transit to Aporiya. If the item is lost or damaged in transit, you may seek compensation through your shipping provider in accordance with their terms. For items valued above £500, Aporiya will cover the shipping and insurance costs once the prepaid shipping label has been provided.
• Risk of Loss After Delivery: Once Aporiya has confirmed in writing that we have received your item, we assume responsibility for any loss, damage, or theft while it is in our physical possession. If such an event occurs, Aporiya may, at its discretion, either (i) repair the item or (ii) compensate you up to the estimated sale value the item would have achieved on our platform.
• Exclusive Remedy: The remedies provided above are your sole and exclusive recourse in the event your item is lost, stolen, or damaged while in Aporiya's care, after we have accepted the item for consignment, as permitted by law.
6. Shipping to Aporiya
• Once an item has been approved for sale, Aporiya will provide instructions for shipping the item for final authentication.
• Shipping Deadlines: Sellers must dispatch the item within 2-3 business days of receiving an approval confirmation.
• Aporiya will provide prepaid shipping labels (for items above £500) for domestic sellers. International sellers will be responsible for shipping costs, communicated during the sale.
• Insurance: Sellers are responsible for insuring items when shipping them to Aporiya. Aporiya is not liable for loss or damage during shipping for items valued under £500. For items valued above £500, Aporiya will cover insurance.
7. Item Condition and Description
• Sellers must provide a true and accurate description of the item’s condition, including any wear, damage, or repairs.
• Images provided must be clear and show the full condition of the item.
If the item does not match the condition described, sellers may be subject to a £25 misrepresentation fee, and the item may be returned at the seller’s expense.
8. Item Submission and Acceptance
• Once Aporiya has approved an item, you will receive confirmation with details of the next steps.
• Aporiya reserves the right to decline any item if it fails to meet the platform’s quality standards.
9. Commission and Fees
• If your item sells on Aporiya, we will deduct a commission from the final sales price of the item
• Commission Rates: The commission percentage depends on the category and price of the item, with exact rates communicated during the listing process. The seller will receive the sale proceeds minus this commission and any applicable fees.
Fee Changes: Aporiya reserves the right to adjust its commission structure at any time. However, sellers will be informed of these changes before their items are listed for sale.
10. Consignment Period
• Once accepted by Aporiya, your item will be listed for sale on the platform for a minimum of 90 days.
• After the initial 90-day consignment period, Aporiya may offer to extend the listing, subject to mutual agreement. If no extension is agreed upon, sellers may request the return of their items at their own expense.
• Aporiya reserves the right to discount or promote the item at its discretion after 60 days to improve the likelihood of sale. This will not exceed a discount of up to 15% of the original listed price unless otherwise agreed upon by the seller.
• If the item remains unsold after the 90-day period and no agreement is made for an extension, the seller can either:
o Arrange collection of the item at their own expense, or
o Re-consign the item for another agreed period.
• Sellers are required to notify Aporiya in writing if they wish to terminate the consignment agreement after the initial period, giving at least 14 days' notice.
• Item Withdrawals: Sellers may withdraw their item before the end of the 90-day consignment period. If you choose to collect an item before the minimum consignment period has ended, you may be responsible for certain fees, including but not limited to authentication, photography, and marketing costs. These fees will not exceed a total of £100.
11. Prohibited Items
The following items are strictly prohibited from being sold on Aporiya:
• Counterfeit goods or items misrepresented as genuine.
• Stolen property or items that have been reported lost.
• Items that infringe intellectual property rights.
• Items that are illegal to sell under UK law.
12. Returns and Cancellations
• Authenticity Complaints: If a buyer disputes the authenticity of an item, Aporiya will investigate the claim. Sellers will be required to issue a full refund if the item is proven counterfeit or misrepresented.
• Misrepresentation: If an item is not as described, Aporiya will facilitate a return. The seller will bear the costs associated with shipping the item back and processing the return.
13. Payouts to Sellers
• Payment Schedule: Sellers will receive payment once the item has been sold, authenticated, and delivered to the buyer. Payments are typically processed within 7 business days from the delivery date.
• Payment Method: Payouts are made via bank transfer. Sellers are responsible for providing accurate and up-to-date payment details.
• Delayed Payments: Aporiya is not responsible for payment delays caused by incorrect bank information or third-party payment processing delays.
14. Seller Conduct and Obligations
• Accurate Descriptions: Sellers must provide honest and accurate descriptions of all items, including details of any repairs or damages.
• Rightful Ownership: Sellers confirm they are the rightful owners of the items listed and there are no legal disputes related to ownership.
• Compliance with Laws: Sellers must adhere to all applicable laws when selling on Aporiya, including those relating to intellectual property and the sale of second-hand goods.
15. Limitation of Liability
• Indirect Damages: Aporiya is not liable for any indirect or consequential damages, including lost sales opportunities or lost profits.
• Maximum Liability: To the extent allowed by applicable law, Aporiya's maximum liability to you under these Seller Terms for any claim will not exceed the final sales value of the item related to the claim.
16. Account Suspension and Termination
• Discontinuation by Seller:
If you are no longer able to agree to these Seller Terms or any updates made to the terms or services, you must immediately stop using Aporiya's platform and request the return of any items you have consigned.
• Termination by Aporiya:
Aporiya reserves the right to immediately terminate your use of the platform if you breach any significant rules, terms, or conditions outlined in these Seller Terms.
• Service Withdrawal:
Aporiya also reserves the right to withdraw or discontinue the platform at any time, with reasonable notice provided to sellers.
• Legal Rights:
Nothing in this section affects your legal rights under the applicable laws of the country in which you reside.
17. Governing Law and Disputes
These Terms and Conditions are governed by the laws of England and Wales. Any disputes related to sales or terms will be subject to the exclusive jurisdiction of the courts in England and Wales.
18. Intellectual Property Rights
All content on Aporiya’s website, including text, images, and designs, is protected by intellectual property laws. Sellers agree not to reproduce or use this content without Aporiya’s written permission.
19. Indemnity
Sellers agree to indemnify Aporiya, its employees, and agents from any claims or liabilities arising from their use of the platform or breach of these Terms and Conditions.
20. Data Protection
Aporiya complies with the UK GDPR. For details on how we collect and use personal data, please review our Privacy Policy, which forms part of these terms.
21. Third-Party Links
Aporiya may contain links to third-party websites. Aporiya is not responsible for the content or practices of these sites. Sellers engage with third-party sites at their own risk.
22. Force Majeure
Aporiya is not liable for failures to fulfil obligations caused by circumstances beyond its control, such as natural disasters, strikes, or disruptions in internet service.
23. Severability
If any provision of these terms is deemed unenforceable by a court, the remaining provisions will remain in full force and effect.
24. Amendments to Terms
Aporiya reserves the right to modify these Terms and Conditions at any time. Sellers will be notified of any updates, and continued use of the platform signifies acceptance of the updated terms.

Sell/Consign Process
1. Submit Item Details
Fill out a form with details of the luxury item you wish to
sell or consign. Provide brand, model, condition, and any authentication
documents or original packaging.
2. Receive Evaluation
Aporiya's team will review the details and evaluate the item
based on market demand, brand, and condition. You'll receive a proposed selling
price or consignment offer.
3. Item Authentication
If you accept the offer, ship the item to Aporiya or drop it
off at an authorised location. The item will undergo a thorough authentication
and condition assessment by our experts.
4. Agree to Terms
Once authenticated, Aporiya will finalise the selling price
or consignment terms, including commission rates and expected time frames for
sale.
5. Item Listing
Your item will be listed on Aporiya's platform, showcased
with professional photos and descriptions to reach potential buyers worldwide.
6. Get Paid
Once your item is sold, you'll receive payment via your
preferred method (bank transfer, PayPal, etc.) after deducting any agreed-upon
commission or fees.
